The Dubai Rental Disputes Center has issued a landmark ruling requiring a landlord to pay AED 700,000 in compensation to a tenant, which is equivalent to three times the annual rent, after it was proven that the landlord had wrongfully manipulated legal procedures to evict the tenant.
The case involved a European tenant who had fully paid the annual rent for the 2023-2024 contract period to the original property owner. However, after the villa was sold to a new landlord, the latter filed a legal case falsely claiming non-payment of rent and sought the tenant’s eviction.
In quite the controversial move, the new landlord deliberately registered an incorrect email address for the tenant when filing the case, preventing legal notifications from reaching him. As a result, the tenant was unaware of the court proceedings and was issued a default judgment for eviction and rental payment.
Taking advantage of the ruling, the landlord proceeded with enforcement actions, including changing the villa’s locks, removing all furniture, and even requesting the court to impose travel bans and financial restrictions on the tenant. Upon returning from his annual vacation, the tenant was shocked to find himself locked out of his own home, with no knowledge of the case against him.
Upon discovering the legal proceedings, the tenant sought legal counsel, successfully proving the landlord’s misconduct. Following a comprehensive investigation, the Rental Disputes Center overturned the eviction ruling and annulled all related enforcement measures.
In addition to reclaiming his tenancy rights, the tenant filed a lawsuit seeking compensation for damages caused by the unlawful eviction. The Rental Disputes Center conducted a thorough assessment, taking into account financial losses, legal expenses, hotel accommodation costs, and the emotional distress endured. After careful consideration, the court ruled in favour of the tenant, ordering the landlord to pay AED 700,000 in damages and reinstating the tenant’s right to the property.
His Excellency Judge Abdul Qader Mousa Mohammed, Chairman of the Dubai Rental Disputes Center, reaffirmed the center’s commitment to protect the rights of both landlords and tenants, ensuring stability in rental agreements, and preventing any misuse of legal frameworks. He cautioned landlords against deceptive practices aimed at unjustly evicting tenants for financial gain, emphasizing that such actions could lead to significant legal and financial consequences.
Furthermore, His Excellency urged tenants to adhere to rental payment obligations and take appropriate legal action if a landlord refuses to accept payment. He also emphasized the importance of maintaining documented communication between landlords and tenants through official platforms, as these records serve as critical evidence in case of disputes.
This ruling showcases the Rental Disputes Center’s dedication to upholding justice and protecting the integrity of Dubai’s rental market, ensuring fair treatment for all parties involved.
